LPA Receivership – managing complex property situations
This derives from the Law of Property Act 1925, which was introduced to improve the clarity and transfer of land ownership. Complex property situations often require a more detailed review than simply collecting rents or selling a piece of land, a building or a site.
Secured lenders use RSM Tenon’s expertise and experience to achieve maximum recovery in complex and challenging situations such as:
- Misappropriation of rents and other income
- Mismanagement of portfolio properties and estates
- Director/management disputes
- Complex or litigious proceedings involving the property.
Although an LPA Receivers powers are more limited than that of an administrator, control is the key. Where the property is not subject to development activity it is critical to ensure that the appropriate skill sets, in some cases including our forensic experts, are utilised to maximise the secured lenders recovery.
